3. Booking Terms & Conditions

3.1 How to Book

To make a booking:

1. Submit a booking inquiry through our website
2. We will respond within 24 hours to confirm availability
3. Upon confirmation, a deposit is required to reserve your dates
4. You will receive a booking confirmation email with full details
5. Final payment is due 14 days before your arrival date

3.2 Booking Confirmation

Your booking is only confirmed when you receive a written confirmation from Petra's Madeira Hideaway. Your booking inquiry does not guarantee availability or constitute a confirmed reservation.

3.3 Minimum Stay

• Main House: Minimum 3 nights
• Bungalows: Minimum 3 nights

Shorter stays may be considered during low seasons. Please contact us for special requests.

3.4 Check-in & Check-out Times

• Check-in: After 3:00 PM
• Check-out: Before 11:00 AM

Early check-in or late check-out may be available upon request (subject to additional fees). Contact us for inquiries.

3.5 Guest Requirements

To complete your booking, you must:

• Be at least 18 years old
• Provide accurate personal information
• Provide valid identification at check-in
• Agree to our House Rules

3.6 Maximum Occupancy

Each property has maximum occupancy limits:

• Main House (Petra's Hideaway): Maximum 10 guests
• Casa da Amendoeira (The Almond Tree House): Maximum 6 guests
• Casa do Cedro (The Cedar House): Maximum 6 guests

Exceeding maximum occupancy is strictly prohibited and may result in cancellation without refund.

4. Payment Terms

4.1 Pricing

All prices are in Euros (€) and include accommodation only, unless otherwise specified. Prices are subject to change until your booking is confirmed.

4.2 Deposit

• Amount: 50% of total booking price
• Due: Upon booking confirmation
• Purpose: Secures your reservation

4.3 Final Payment

• Amount: Remaining 50% of booking price
• Due: 14 days before arrival date
• Late Payment: May result in booking cancellation

4.4 Payment Methods

We accept the following payment methods:

• Bank transfer (IBAN)
• PayPal
• Credit/Debit cards (via secure payment processor)

4.5 Additional Charges

The following may incur additional charges (clearly communicated before booking):

• Early check-in (before 3:00 PM)
• Late check-out (after 11:00 AM)
• Extra guests beyond the base occupancy
• Damage to property
• Cleaning fees for excessive mess
• Utilities overages (if applicable)

4.6 Taxes & Fees

Local tourist taxes or statutory fees may apply, depending on Portuguese regulations. These will be clearly communicated before booking confirmation.

4.7 Currency

All transactions are processed in Euros (€). Foreign currency conversion fees may apply depending on your payment method or bank.

5. Cancellation Policy

5.1 Cancellation Periods & Refunds

Cancellation terms depend on booking dates and seasonal conditions:

Low Season (November - March)

• Cancelled 60+ days before arrival: 80% refund of deposit
• Cancelled 30-59 days before arrival: 50% refund of deposit
• Cancelled 14-29 days before arrival: No refund
• Cancelled less than 14 days before arrival: No refund

High Season (April - October)

• Cancelled 90+ days before arrival: 90% refund of deposit
• Cancelled 60-89 days before arrival: 50% refund of deposit
• Cancelled 30-59 days before arrival: 25% refund of deposit
• Cancelled less than 30 days before arrival: No refund

5.2 How to Cancel

To cancel your booking, email us at info@gomadeira.co with your booking reference number.

Cancellation is effective when we receive your email. We will respond within 48 hours with confirmation and refund details (if applicable).

5.3 No-Shows

If you fail to arrive for your booking without notifying us, your entire payment is forfeited and no refund will be issued.

5.4 Weather or Force Majeure

In cases of severe weather, natural disasters, or other unforeseeable circumstances that make travel unsafe or the property unavailable, we may offer:

• Rescheduling to alternative dates
• Full refund (at our discretion)

5.5 Our Right to Cancel

We reserve the right to cancel any booking if:

• Payment is not received as agreed
• You provide false or misleading information
• Property becomes unavailable due to emergency
• You breach our House Rules or Terms of Service

In such cases, we will make a reasonable effort to notify you and offer alternative dates or a full refund.

6. Guest Conduct & House Rules

6.1 Respect for Property

You agree to:

• Treat the property and all furnishings with care
• Report any damage or issues immediately
• Return all keys and property items at checkout
• Leave the property in clean condition

6.2 Noise & Disturbance

• Excessive noise is prohibited, especially between 10:00 PM and 8:00 AM
• You are responsible for the behavior of all guests in your party
• We reserve the right to end your stay if disturbances continue

6.3 Smoking & Substance Policy

• Smoking is NOT permitted inside the accommodations
• Smoking is allowed only on outdoor terraces
• Disposal of cigarette butts responsibly is required
• Illegal drugs are strictly prohibited
• Violation will result in immediate eviction without refund

6.4 Pets

Pets are NOT permitted unless explicitly approved in advance. Unauthorized pets will result in:

• Additional cleaning fees (€100+ per pet)
• Potential eviction

6.5 Parties & Events

• Parties, gatherings, or commercial events are NOT permitted
• The property is for residential use by guests only
• Using the property for events requires prior written approval

6.6 Damage Liability

You are responsible for any damage to the property caused by you or your guests, beyond normal wear and tear. Damage charges will be deducted from your deposit or billed separately.

7. Liability & Disclaimer

7.1 Assumption of Risk

You acknowledge that your stay at Petra's Madeira Hideaway involves inherent risks, including but not limited to:

• Natural elements and weather
• Activities in Madeira (hiking, water activities, etc.)
• Travel to and from the property
• Interactions with other guests

By booking, you assume all risks associated with your stay.

7.2 Limited Liability

Petra's Madeira Hideaway is NOT liable for:

• Personal injuries or accidents during your stay
• Loss, theft, or damage to your personal belongings
• Cancellations or changes due to circumstances beyond our control
• Weather-related disruptions or natural disasters
• Third-party services or vendors (restaurants, tour operators, etc.)
• Actions or negligence of other guests

7.3 Valuables

We strongly recommend:

• Securing valuables in locked safes
• Not leaving items unattended
• Using the property safe provided (at Main House)

We are NOT responsible for theft or loss of personal items.

7.4 Property Condition

While we maintain our properties to high standards, we do not guarantee:

• Uninterrupted internet or phone service
• Constant hot water or electricity
• Specific weather or climate conditions
• Absence of insects or wildlife (normal for Madeira)

We will address maintenance issues promptly, but minor inconveniences do not warrant refunds.

7.5 Insurance Recommendation

We recommend purchasing travel insurance that covers:

• Trip cancellation
• Personal injury and medical expenses
• Loss of personal belongings
• Emergency evacuation

8. Disputes & Limitation of Liability

8.1 Governing Law

These Terms of Service are governed by the laws of Portugal, specifically applicable in Madeira.

8.2 Dispute Resolution

If a dispute arises:

2. We will attempt to resolve the issue within 30 days
3. If unresolved, the dispute may be subject to Portuguese legal proceedings

8.3 Limitations

To the maximum extent permitted by law, Petra's Madeira Hideaway's liability is limited to the total amount you paid for your booking. We are NOT liable for:

• Indirect or consequential damages
• Lost profits or lost business
• Personal injury claims beyond insurance coverage

9. Accessibility & Website Accuracy

9.1 Website Availability

We strive to keep our website available 24/7, but we do not guarantee uninterrupted access. We may temporarily take the website offline for maintenance or updates.
